Nevada’s marijuana DUI laws

Despite having recreational sales, Nevada still has strict marijuana DUI laws. According to NRS 484C.110 and NRS 453.336, it is a crime to drive while:

The driver has consumed marijuana “to a degree which renders the driver incapable of safely driving or exercising actual physical control of a vehicle”; OR
The driver’s blood contains 2 nanograms per milliliter of marijuana (Delta-9-THC) or five nanograms per milliliter of marijuana metabolite (11-hydroxy-THC).
This means drivers don’t necessarily have to be “high” for a cop to arrest you for violating DUI marijuana laws; if a driver’s blood contains the minimum prohibited amount while operating a vehicle, it is considered “illegal per se” even if you were driving safely.
